接下来先跟大家解释一个转聘的概念：外国人变换了工作单位但工作岗位未变动，且工作类居留许可仍在有效期内，可以直接在新公司申请工作许可证及居留许可签证，无需在新公司重新申请工作许可通知。

Next, I would like to explain to you the concept of employment transfer: the foreigner has changed his/her work unit, but his/her position is still the same, and his/her work residence permit is still valid. He/she can directly apply for work permit and residence permit visa in the new company, and does not need to apply for notification letter of foreigner’s work permit again in the new company.

我们必须先确认好外籍人是否符合转聘的申请条件，也就是要求：

1、外国人的居留许可在有效期内

2、新工作岗位需要与原工作岗位保持一致

We must first confirm whether the foreigner meets the application conditions for transfer, that is, requires:

1. The foreigner's work residence permit is still valid

2. The new position needs to be consisten with the old one

确认符合办理要求，转聘办理的流程如下：

1、提前与原单位协商辞职，获得离职证明；

2、注销原单位的工作许可证；

3、在新公司申请新的工作许可证；

4、申请新的工作类居留许可签证

If confirm that it meets the requirements for processing, and the process of transfer is as follows:

1. Negotiate with the original unit to resign in advance and obtain the resignation certificate;

2. Cancel the work permit of the original unit;

3. Apply for a new work permit in the new company;

4. Apply for a new work residence permit

首先了解一下转聘需要注销外国人工作签证的原因：

1、外国人与公司结束劳动合同关系时，必须注销工作签证，企业只有给外国人同时办理工作许可和居留许可注销后，才被视为聘用单位劳动关系真正意义上的解除。在注销居留许可后，外国人将拿到30天的停留签证，期间如果找到其他单位的就业机会，可以申请办理转聘。

2、提供来华工作许可注销证明，才能办理养老保险退费、医疗保险个人账户一次性处理等事项。

First of all, we need to know the reasons why we need to cancel the foreigner's work visa:

1.A foreigner must cancel his/her work visa when he/she ends the labor contract relationship with the company. The company shall only cancel the work permit and residence permit for the foreigner at the same time, it is regarded as the real termination of the labor relationship of the employer.After the residence permit is cancelled, the foreigner will get a 30-day stay visa. If he/she find employment opportunities in other units,he/she can apply for the transfer.

2.To provide work permit cancellation certificate in China, in order to deal with pension insurance refund, medical insurance individual account one-time processing and other matters.

转聘需要的资料：

1. 外国人来华工作许可申请表

2. 聘用合同

3. 有效居留许可、护照信息页

4. 注销证明

5. 其他材料如学历、无犯罪认证、体检等则不需要重新准备和提交。如果新公司没有招聘过外国人，还需要重新办理外专局系统注册和涉外企业备案。

转聘注意事项：

1. 外国人的居留许可在有效期内

2. 新工作岗位需要与原工作岗位保持一致

3. 外国人需要获取原公司的离职证明

4. 不在居留许可有效期内或者换了不同岗位（职业）的工作，则需要按境外重新申请《外国人工作许可证》

Notes:

1. The foreigner's work residence permit is still valid

4.If Foreigners do not work in the validity period of your residence permit or change his/her position (occupation), he/she need to apply for a foreigner's work permit again
