随着国际化进程的加快，越来越多的企业对于外籍员工招聘需求增加，对于外籍员工的离职手续如何办理，大多数企业都会认为，合同到期或者外籍员工自动离职就可以了。

事实上，外籍员工离职不仅需要企业为其开具离职证明，还需要办理工作许可居留注销。

一、在中国工作的外国人离职以后，为什么要注销?

Why we need cancellation procedures?

外国人与公司结束劳动合同关系时，必须注销工作签证，企业只有给外国人同时办理工作许可和居留许可注销后，才被视为聘用单位劳动关系真正意义上的解除。

A foreigner must cancel his/her work visa when he/she ends the labor contract relationship with the company. 

The company shall only cancel the work permit and residence permit for the foreigner at the same time, it is regarded as the real termination of the labor relationship of the employer.

更通俗的讲，但凡外籍员工离职，公司是一定要帮其办理就业证和居留许可的双重注销手续。若用人单位为了省时省事，只注销了工作许可证，外籍人并未完成居留许可签证变更，工作签证关系并未完全解除，仍在原单位，期间如果外国人出现任何违法行为或者人身意外，公司可能会有连带责任。

美国签证找大鹤建议在雇佣双方合同即将到期之前，可限定一个期限给予外国人适当时间找到新工作和办理相关变更手续。

Generally speaking, when foreign employees leave the company, the company must help him to handle the cancellation procedures of employment permit and residence permit.

If the employer only cancels the work permit to save time and trouble, and the foreigner does not complete the change of residence permit visa,the work visa relationship has not been completely dissolved, and the company may have joint responsibility during this period.

Usadahe suggest setting a time limit before the expiration of the employer's contract to give the foreigner appropriate time to find a new job and go through the change procedures.

在注销居留许可后，外国人将拿到30天的停留签证，企业只办理工作许可证注销手续，外国人可拿注销证明变更到其他单位，并延期居留许可签证。

After the residence permit is cancelled, the foreigner will get a 30-day stay visa. 

The company will only go through the cancellation procedure of the work permit. 

The foreigner can change the cancellation certificate to other company and extend the residence permit visa.

二、外国人来华工作许可证注销材料

2、聘用关系解除、合同终止或其他与注销原因相关的证明材料

3、其他材料：许可受理机构根据需要要求进行补充提供的材料

三、外国人来华工作许可证注销流程

1、将注销信息录入“外国人来华管理服务系统”

2、打印“外国人工作许可注销申请表”

3、递交纸质材料于当地外专局，注销其工作许可证
