We are now in a period of high incidence of the epidemic. These people enter the country through illegal channels and have not passed the border inspection and customs inspection. There is a risk of epidemic spread, which will affect our normal work and life. 2022年2月17日至2022年3月8日期间，越南籍人员武某持旅游签证在华非法居留，并在无就业许可证的情况下在个体户孙某家中从事材料价格工作，实际工作20天。其已构成非法居留和非法就业，警方依法对其处罚款一万五千元，对个体户孙某处罚款一万元。

Typical case: During the period from February 17, 2022 to March 8, 2022, Wu, a Vietnamese national, illegally stayed in China with a tourist visa, and engaged in material price work at the home of sun, a self-employed person, without an employment permit. He actually worked for 20 days. It has constituted illegal residence and illegal employment. The police will impose a fine of 15000 yuan on him and a fine of 10000 yuan on the self-employed sun somewhere.

根据《中华人民共和国出境入境管理法》第七十八条之规定，外国人非法居留的，给予警告；情节严重的，处每非法居留一日五百元，总额不超过一万元的罚款或者五日以上十五日以下拘留。

问题四：哪些情形属于非法就业？

根据《中华人民共和国出境入境管理法》第四十三条之规定，外国人有下列行为之一的，属于非法就业：

（一）未按照规定取得工作许可和工作类居留证件在中国境内工作的；

（二）超出工作许可限定范围在中国境内工作的；

（三）外国留学生违反勤工助学管理规定，超出规定的岗位范围或者时限在中国境内工作的。
