《中华人民共和国出境入境管理法》第四十一条规定：

外国人在中国境内工作，应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。

Article 41:

 Foreigners who work in China shall obtain work permits and work-type residence permits in accordance with relevant regulations. No entities or individuals shall employ foreigners who have no work permits or work-type residence permits.

According to the regulations, foreigners who come to work in China must apply for work permit and work-type residence permit, which are complete before they can work legally. How to handle it is the most important issue for foreigners and employers. Today, Dahe will summarize the six procedures for foreigners to work in China, so that you can quickly grasp the essentials of applying for China's work visa (work permit+work-type residence permit).

一、申请外国人来华工作许可通知

外国人想要来中国工作的第一步就是要先获得工作许可通知。系统录入外国人的信息，上传无犯罪认证件和学历认证件等其他文件，通过审核后就可以获得工作许可通知（中英两版）。外国人工作许可通知的有效期只有3个月，需要在三个月内携带《通知》去中国驻外使馆申请Z字工作签证，过期将会失效。这一步通常由国内的用人单位来操作，你只需要把材料交给你的用人单位就可以了，用人单位会在外国人来华工作管理服务系统注册账号并提交相应材料。（特别提醒：深圳市则是使用深圳市外国人综合服务管理平台来提交相应材料）

The first step for foreigners wanting to work in China is to get a work permit notification. The system records the foreigner's information and uploads other documents, such as a non-criminal certification and education certification. After passing the examination, the applicant can get work permit notification (both Chinese and English versions). This notification is valid for only 3 months. You need to bring the it to the Chinese embassy in your country to apply for Z visa within 3 months. After expiration, it will be invalid. This step is usually operated by domestic employers. You only need to submit the materials to your employer. The employer will register an account in the Service System for  foreigners working in China and submit the corresponding materials. (Special reminder: Shenzhen city uses the Shenzhen Foreigner Integrated Service Management Platform to submit corresponding materials.)

申请Z字工作签证入境 Apply for Z visa

取得外国人来华工作许可通知之后，就可以去所在国家的中国使馆或领事馆申请Z字工作签证。工作签证通过后即可着手安排机票预订事宜。

After obtaining the Notification letter of foreigner’s work permit, you can go to the Chinese embassy or consulate in your country to apply for a Z visa. After the Z visa is approved, the air ticket reservation can be arranged.

申请Z字工作签证材料清单：

3）合法停留或居留证明（适用于不在国籍国申请签证者）

三、办理境外人员临时住宿登记、拍照 

Registration of temporary residence for visitors、take photos

根据《中华人民共和国出境入境管理法》第三十九条第二款规定，外国人在旅馆以外场所居住或住宿的，入住后二十四小时内必须申报住宿登记，否则将给予警告同时可以并处以二千元以下罚款。

在来到中国境内之后，如果你在中国境内的旅馆住宿，那么不用担心，旅馆会按照有关规定为你办理住宿登记，并向所在地公安机关报送你的住宿登记信息。但是如果你在旅馆以外的其他住所居住，就必须在入住的二十四小时内由本人或者留宿人，向居住地的公安机关办理临时住宿登记。除此之外，还需要去照相馆拍照，弄到外国人签证照片回执，以便后续申请居留许可使用。

In accordance with the provisions of the second paragraph of Article 39 of“Exit and Entry Administration Law of the People’s Republic of China”, foreigners who reside or lodge in places other than hotels must declare their residence registration within 24 hours after check-in. Otherwise they will be given a warning and may be concurrently fined not more than 2000 yuan.

After arriving in China, if you stay in a hotel in China, don't worry. The hotel will register for you according to relevant regulations and submit your registration information to the local public security organ. However, if you live in a residence other than the hotel, you must register for temporary accommodation with the local public security organ within 24 hours of your stay. In addition, you also need to go to the photo studio to take photos and get the receipt of the foreigner's visa photos so that you can apply for a residence permit later.
