近日,某广州幼儿园因非法聘用3名外国人,被广州市公安局黄埔区分局予以罚款3万元。具体违法事实为:该幼儿园聘用阿尔及利亚籍男子、乌干达籍女子、塞尔维亚籍男子,前述三人在没有取得工作类居留许可和工作许可证的情况下工作,此行为已构成非法就业,该幼儿园的行为已构成非法聘用外国人。

Recently, a Guangzhou kindergarten was fined 30000 yuan by the Huangpu District Branch of the Guangzhou Public Security Bureau for illegally hiring three foreigners. The specific illegal facts are: the kindergarten employs Algerian men, Ugandan women, and Serbian men. 根据《中华人民共和国出境入境管理法》第四十三条之规定,外国人有下列行为之一的,属于非法就业:

(一)未按照规定取得工作许可和工作类居留证件在中国境内工作的;

(二)超出工作许可限定范围在中国境内工作的;

(三)外国留学生违反勤工助学管理规定,超出规定的岗位范围或者时限在中国境内工作的。

According to Article 43 of the law of the people's Republic of China on entry and exit administration: Any of the following acts of foreigners shall be deemed unlawful employment:

(1) Work in China without obtaining work permits or work-type residence permits in accordance with relevant regulations;

(2) Work in China beyond the scope prescribed in the work permits; or

(3) Foreign students work in violation of the regulations on the administration of foreign students working to support their study in China and work beyond the prescribed scope of jobs or prescribed time limit.

根据《中华人民共和国出境入境管理法》第四十一条之规定,外国人在中国境内工作,应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。

According to Article 41 of the law of the people's Republic of China on entry and exit administration: Foreigners who work in China shall obtain work permits and work-type residence permits in accordance with relevant regulations. No entities or individuals shall employ foreigners who have no work permits or work-type residence permits.

《中华人民共和国出境入境管理法》第八十条  外国人非法就业的,处五千元以上二万元以下罚款;情节严重的,处五日以上十五日以下拘留,并处五千元以上二万元以下罚款。

    介绍外国人非法就业的,对个人处每非法介绍一人五千元,总额不超过五万元的罚款;对单位处每非法介绍一人五千元,总额不超过十万元的罚款;有违法所得的,没收违法所得。

    非法聘用外国人的,处每非法聘用一人一万元,总额不超过十万元的罚款;有违法所得的,没收违法所得。

第八十一条  外国人从事与停留居留事由不相符的活动,或者有其他违反中国法律、法规规定,不适宜在中国境内继续停留居留情形的,可以处限期出境。

外国人违反本法规定,情节严重,尚不构成犯罪的,公安部可以处驱逐出境。公安部的处罚决定为最终决定。

被驱逐出境的外国人,自被驱逐出境之日起十年内不准入境。

Article 80 in the law of the people's Republic of China on the administration of exit and entry, aliens who engage in illegal employment shall be fined not less than 5000 yuan but not more than 20000 yuan; if the circumstances are serious, they shall be detained for not less than five days but not more than 15 days and shall also be fined not less than 5000 yuan but not more than 20000 yuan.

For those who introduce foreigners to work illegally, they shall be fined 5000 yuan for each person they introduce illegally, with a total amount not exceeding 50000 yuan; for those who introduce foreigners illegally, they shall be fined 5000 yuan for each person they introduce illegally, with a total amount not exceeding 100000 yuan; for those who have illegal income, their illegal income shall be confiscated.

注意:可入境前采用承诺制,入境后申领《中华人民共和国外国人工作许可证》时应补充提交中国境内检验检疫机构出具的境外人员体格检查记录验证证明或健康检查证明书。

Those who illegally employ foreigners shall be fined 10000 yuan for each person illegally employed, and the total amount shall not exceed 100000 yuan; if there is any illegal income, the illegal income shall be confiscated.

Article 81 aliens who engage in activities inconsistent with the reasons for their stay or residence, or who violate the provisions of Chinese laws and regulations and are not suitable for their continued stay or residence in China, may be ordered to leave the country within a time limit.

If an alien violates the provisions of this Law and the circumstances are serious enough not to constitute a crime, the Ministry of public security may order him to be deported. The punishment decision of the Ministry of public security is final.

Aliens who have been expelled shall not be allowed to enter China for ten years from the date of their expulsion.
